Clearly it was faked! Consider:
First of all, his jacket appears to be flapping in the breeze, yet the furled sail to his left (your right) appears to be completely static -- a physical impossibility!
Secondly, the sky is a brilliant blue color. However, at the time the picture was supposed to have been taken, the Caribbian (where most pirates are found) was overcast -- a clear giveaway.
Finally, note that the shadows cast by his legs point in a different direction than the shadow cast by his crotchular area -- again, impossible.
Clearly, this picture was put together by a conspiracy of anti-Disney communists!
